Who we are

Lakepoint Capital Inc. ("Lakepoint", "we", "us") is a corporate debt advisory firm and licensed mortgage brokerage based in Kelowna, British Columbia. We arrange commercial financing for businesses and commercial property owners. Our office is at Unit 508 – 550 Osprey Ave, Kelowna, BC V1Y 5A6. This policy explains how we collect, use, disclose and protect personal information in the course of our business and on this website, in accordance with the Personal Information Protection Act (British Columbia) and the Personal Information Protection and Electronic Documents Act (Canada).

What we collect

Client identification and verification information: name, address, date of birth, government-issued photo identification and the authority of individuals acting for a business. Financial information: financial statements, tax filings, bank and loan statements, personal net worth statements, credit history and, with your express consent, credit reports from credit reporting agencies. Contact and communication information: email address, telephone number and the content of our correspondence. Website information: pages visited, browser type, device and IP address, collected through cookies and analytics provided by our website host.

Why we collect it

To assess and arrange commercial financing on your behalf; to prepare financing requests and present them to lenders; to verify identity and meet our obligations under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act and the Mortgage Services Act (British Columbia); to invoice and collect fees; to communicate with you about your engagement and, with your consent, about our services; and to operate, secure and improve this website.

Who we share it with

Lenders and their representatives, for the purpose of obtaining financing you have engaged us to arrange; lawyers, accountants, appraisers, insurers and other professionals involved in a financing; credit reporting agencies, where you have authorized a credit report; regulators, including the BC Financial Services Authority and FINTRAC, where required by law; and service providers that process information on our behalf, including our website host, document-sharing and e-signature platforms, customer-relationship software, accounting software (Intuit QuickBooks Online) and AI-assisted productivity tools. Service providers may only use personal information to provide their services to us. We do not sell personal information, and we do not receive fees or compensation from lenders.

Our accounting software connection

Lakepoint uses an internal integration with Intuit QuickBooks Online to create and retrieve Lakepoint's own invoices and financial reports. The integration connects only to Lakepoint's own QuickBooks company file, is used only by Lakepoint personnel, and does not access the QuickBooks data of any other business. Client information stored in QuickBooks is limited to what is needed to issue and record invoices: business name, contact name, address and email, and the invoice amounts.

Consent

We collect, use and disclose personal information with your consent, which you may give in our engagement documents, by providing information to us, or as implied by the nature of the services you request, except where the law permits or requires otherwise. You may withdraw consent at any time, subject to legal and contractual restrictions and reasonable notice; withdrawing consent may limit our ability to act for you.

Retention

We keep client records, including personal information, for at least seven years after the end of an engagement, which is the longer of the periods required under the Mortgage Services Act and the Proceeds of Crime (Money Laundering) and Terrorist Financing Act, and then destroy them securely.

Safeguards

We protect personal information with physical, organizational and technical measures appropriate to its sensitivity, including access controls, encrypted storage and transmission, and confidentiality obligations on our personnel and service providers. Some service providers store information outside British Columbia, including in the United States, where it may be subject to the laws of those jurisdictions.

Electronic communications

With your consent we may send you electronic messages about your engagement and about our services, in compliance with Canada's Anti-Spam Legislation. You can unsubscribe from marketing messages at any time using the link in the message or by contacting us.

Cookies and analytics

This website is hosted on Wix and uses cookies and similar technologies to operate the site and understand how it is used. You can control cookies through your browser settings; some features may not work without them.

Your rights

You may ask to see the personal information we hold about you, ask us to correct it, and ask how it has been used and disclosed. We respond within the time the law allows and may charge a minimal fee for access requests where permitted. We may withhold information where the law requires or permits, for example information subject to solicitor-client privilege or that would reveal another person's personal information.
